Data protection policy
I) Identity of the data controller
AB REAL ESTATE SAS with capital of €8,000, registered in the Béziers Trade and Companies Register under number 439448127 and whose registered office is located at 3 rue du Devès, 34480 Saint Geniès de Fontédit, France (hereinafter referred to as “the Company”).
II) Terminology
User: any natural person, with or without an account, using the Company’s services or Site as a customer or simple visitor to the Site.
Site: this is the Company’s www.ab-real-estate.com website.
III) Collection, conditions and purposes of data processing
The Company collects personal data (surname, first name, home and e-mail address, telephone number, IP address, photos of the property, etc.) from Users who browse, consult and/or enter personal information on our Site in order to access our services.
This data is collected when the User :
create an account
subscribes to the newsletters or alerts offered by the Company, makes a return request on the site
contacts the Company’s Customer Service department using any means of communication available to it, such as e-mail, instant messaging (chat), telephone, whatsapp, etc.
browses the Site and consults articles
write a comment or an opinion on an article
share a review with a friend by sending an e-mail from a file
share a review via Facebook, Google +, Twitter, linkedin, Instagram, Pinterest, etc. from an article page
fills in a form to enter information or send correspondence on the Site
The data collected is required for the following purposes:
Management and monitoring of commercial relations between the Company and the customer (in particular operations relating to the search for properties for purchase, the search for properties for sale, property transactions, payments and invoices, complaints, information, etc.).
Commercial prospecting (see “Newsletters” below)
Personalisation of Site content, display of targeted advertising, particularly on social networks.
Sharing of information with our partners in connection with the Company’s activity (property websites/portals, estate agencies, agency networks, tradesmen, notaries, estate agents, insurance companies, banks, etc.), hereinafter referred to as “Partners”.

Account creation, forms and questionnaires
The User must complete all the fields on the form for creating an account, entering information or sending correspondence on the Site, with the exception of fields displayed as optional, i.e. not marked with an asterisk. Optional information is collected by the Company and is used to get to know Site Users better.
Any failure to answer a compulsory field or the absence of agreement on the PPD will result in the form not being sent to the Company.
Data recipients
The data collected is intended for use by the Company. The data may be transmitted to Partners in connection with the Company’s activity, police services or judicial authorities in the context of legal requests. Data may also be processed by subcontractors used by the Company to create, update, maintain and store databases, with a view to providing the Company’s services and preventing and combating fraud.
IV) User rights and protection
1) Right of access, rectification and deletion of data; right to object to processing.
Users have the right to access, rectify and delete their personal data. Users may expressly object to the processing of their personal data. To do so, they should write to the Company, AB Real Estate, 3 rue du Devès, 34480 Saint Geniès de Fontédit, France. The User must indicate his/her surname, first name and postal address. Their request must be signed and accompanied by a valid form of identification bearing their signature. The User may specify the address to which the reply should be sent. The Company has a period of 3 months from receipt of the User’s request to respond. At the end of this period, the Client may refer the matter to the CNIL in the event of a negative response or no response from the Company.
2) Data portability
The User has the right to the portability of personal data processed automatically, which gives him/her :
The right to receive personal data in a structured format
The right to have personal data transferred directly from one controller to another, unless this is technically impossible.
3) Transfer of personal data outside the European Union
Personal data is stored, hosted and processed in the European Union.
4) Data retention period and right to be forgotten
4.1 The Company keeps the data for a period of ten years from the end of the relationship with the customer or prospect. The period begins either with the last transaction carried out, or the last request made, or the last call to customer service, or the sending of an email to customer service, or a click on a hypertext link in an email sent by the Company, or a positive response to an email asking whether the customer wishes to continue to receive information or alerts at the end of the ten-year period. Nonetheless, information used to establish proof of a right or contract, or kept to comply with a legal obligation, may be archived in accordance with the legal provisions and regulations in force.
At the end of this period, the customer’s or prospect’s data will be completely anonymised or destroyed.
4.2 Notwithstanding the foregoing, the User has the right to forget and delete personal data processed by the Company, subject to the Company’s right to retain certain data in respect of its professional civil liability, its tax obligations and legal requirements.
The User must notify his request in the same way as for the right of access above.
5) What happens to personal data after death
The Company informs the User that he/she may, during his/her lifetime, define directives relating to the conservation, deletion and communication of his/her personal data after his/her death. These instructions may be general or specific. Users may modify or revoke their instructions at any time. To do so, the User may contact the Company under the same conditions as for the right of access set out above.
6) Specific functions
Company newsletters – E-mail alerts
When creating an account or registering and subsequently managing their preferences, or depending on the choice of certain services, Users may subscribe to the Company’s newsletter or email alerts and thus choose to be informed at regular intervals of the offers on offer. Users may unsubscribe at any time by clicking on the appropriate link at the bottom of each newsletter.
Sms / Mms / Whatsapp / Signal / Telegram etc.
The Company may use the customer’s mobile telephone number to communicate offers, requests and alerts. At any time, the customer has the option of objecting simply and free of charge, or of unsubscribing from alerts, on the Site in the “My account” section, or by post to the following address: 3 rue du Devès, 34480 Saint Geniès de Fontédit, France.
Cookies
Cookie definition
A cookie is a small text file that is placed or stored on your terminal (computer, tablet or mobile device) when you visit a website. The cookie enables a site to recognise you, to help you navigate from page to page on a website, provides secure connections and remembers your preferences for future visits. The Company uses cookies to recognise the User (whether a customer or not) when connecting to the Site. They are anonymous and do not collect or store personal data.
Deleting cookies
Users may deactivate the cookies stored on their terminal at any time. To do so, simply use the button provided for this purpose on the legal information page or select the appropriate settings in your browser and consult your browser’s help menu.
However, this deactivation may have the effect of preventing access to certain features of the Site that enable the personalisation of the services offered by the Company.
Web beacons
The Company uses web beacons on certain pages of the Site to count the number of visitors to the page and to update the site. These web beacons may be used with some of our partners, in particular to measure and improve the effectiveness of our services. The information collected via these web beacons is anonymous and makes it possible to determine the number of visitors to certain pages of the Site, in order to better assist Site Users.
Social networking plugins
The Site uses social network plugins such as Facebook, Twitter, Pinterest, etc. (hereinafter referred to as “Social Networks”). For example, if the User is connected to Facebook when browsing the Site, Facebook will be able to directly link their visit to their Facebook user account even if the User has not used the share button. If the User interacts using the plugins, for example by clicking on the “Like” button or leaving a comment, the corresponding information will be transmitted to and stored on a Facebook server. It will be published on the User’s Facebook account.
The Company does not manage the data collected by the Social Networks via the buttons. The User must read the policy on the protection of personal data published by the Social Networks concerned in order to find out how the data collected by the latter is processed and used, as well as the options available for setting parameters to protect the User’s privacy. If the User does not wish the Social Network to link the information collected via the Company to his/her Social Network user account, he/she must disconnect from the Social Network before consulting the Site.
Security measures taken by the Company to protect personal data
The Company implements all appropriate technical means in accordance with best practice, to maintain the integrity, digital and physical security and confidentiality of the data and in particular to prevent it from being distorted, damaged or accessed by unauthorised third parties, in particular by implementing encryption, access codes, firewalls, anti-virus software and all other appropriate technical means.
